These Terms of Use (“Terms”) are an agreement between you and AI Commons (“AI Commons,” “we,” “us,” or “our”). They govern your access to and use of aicommons.org and other AI Commons websites, tools, and online services that link to these Terms (together, the “Services”).
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. Separate terms may apply to a particular program, event, repository, license, contribution, or partnership. If separate terms conflict with these Terms, the separate terms control for that activity.
Purpose of the Services
AI Commons provides information, research, public resources, convening tools, and infrastructure related to responsible and trustworthy artificial intelligence. Content available through the Services is for general informational and educational purposes. It is not legal, financial, medical, security, compliance, or other professional advice and should not be treated as a substitute for advice from a qualified professional.
Eligibility
You may use the Services only if you can legally agree to these Terms. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms on your behalf. The Services are not directed to children under 13.
If you use the Services for an organization, you represent that you have authority to bind that organization. In that case, “you” includes both you and the organization.
Acceptable use
You agree not to misuse the Services or help anyone else do so. You may not:
- violate any applicable law, regulation, or third-party right;
- interfere with, disrupt, damage, or place an unreasonable load on the Services or related systems;
- bypass or attempt to bypass access controls, security measures, usage limits, or authentication requirements;
- probe, scan, or test a system vulnerability without written authorization;
- introduce malicious code, scrape the Services in a manner that impairs their operation, or use automated means contrary to posted instructions;
- impersonate another person, misrepresent your affiliation, or use the Services for fraud, harassment, or abuse;
- upload or transmit content that is unlawful, infringing, deceptive, defamatory, threatening, or invasive of privacy; or
- use AI Commons names, logos, content, or Services to imply sponsorship, endorsement, certification, or affiliation that we have not approved in writing.
Good-faith security research requires advance written authorization and compliance with any scope and disclosure instructions we provide.
Accounts and restricted areas
Some features require an account or specific organizational authorization. You must provide accurate information, keep your credentials secure, and promptly notify us if you suspect unauthorized access. You are responsible for activity under your account to the extent permitted by law. An account does not by itself grant permission to use administrative tools or access non-public content.
Content, trademarks, and separate licenses
The Services and their content—including text, design, graphics, logos, software, and compilations—are owned by AI Commons or its licensors and are protected by intellectual-property and other laws. Subject to these Terms, AI Commons gives you a limited, non-exclusive, revocable, non-transferable right to access and use the Services for lawful, non-commercial informational and educational purposes.
Certain materials, datasets, code, documentation, or other resources may be marked with an open-source, Creative Commons, AMPL, or other license. The license displayed with that material—not this general permission— governs your use of it. If no separate license is displayed, you may link to the material and make reasonable quotations with attribution, but you may not reproduce or distribute substantial portions without permission or an applicable legal exception.
No right to use AI Commons trademarks, names, logos, or branding is granted except to accurately identify or refer to AI Commons in a manner that does not imply endorsement.
Your submissions and feedback
You retain ownership of content you submit. You represent that you have the rights needed to provide it and that our permitted use will not violate law or another person’s rights. When you submit content for publication or collaborative use, you grant AI Commons a worldwide, non-exclusive, royalty-free license to host, reproduce, format, display, and distribute that content as reasonably needed for the purpose you submitted it. Any separate contribution or project agreement controls if it grants different rights.
Suggestions and general feedback are voluntary and non-confidential. We may use them without restriction or compensation. Do not send confidential, proprietary, export-controlled, or sensitive personal information through a general contact form unless we have agreed in writing to receive it.
Third-party services and links
The Services may link to third-party websites, repositories, tools, or content. AI Commons does not control and is not responsible for those third parties, their availability, or their practices. A link does not imply endorsement. Your use of a third-party service is governed by its own terms and policies.
Changes and availability
We may add, change, suspend, or discontinue any part of the Services. We do not promise that content will always be complete, current, or available. References to projects, standards, partners, events, or future work are informational and do not create a commitment to deliver a particular feature, result, funding opportunity, or partnership.
Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” AI Commons disclaims all express or implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and security. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that any content will meet your requirements.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
Limitation of liability
To the fullest extent permitted by law, AI Commons and its directors, officers, personnel, contractors, contributors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities, arising from or related to the Services, even if advised that such harm was possible.
To the fullest extent permitted by law, the total liability of AI Commons for all claims arising from or related to the Services will not exceed one hundred U.S. dollars (US $100). These limitations do not apply where prohibited by law or to liability that cannot legally be limited.
Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless AI Commons and its directors, officers, personnel, and contractors from third-party claims, damages, and reasonable costs arising from your unlawful use of the Services, your submitted content, or your material violation of these Terms. This obligation does not require you to indemnify a party for its own unlawful conduct.
Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access when reasonably necessary to protect the Services or others, investigate suspected misuse, comply with law, or address a violation of these Terms. Provisions that by their nature should survive will remain in effect, including provisions about ownership, disclaimers, liability, indemnity, and disputes.
Applicable law and disputes
Before filing a formal claim, you and AI Commons agree to make a good-faith effort to resolve the dispute informally by providing written notice and allowing 30 days for a response. These Terms are governed by applicable law, without regard to conflict-of-law principles. Any claim that cannot be resolved informally may be brought in a court with lawful jurisdiction. Nothing in these Terms limits rights or remedies that cannot be waived under applicable law.
General terms
If a provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of an organizational transaction. These Terms and any applicable supplemental terms are the entire agreement about your use of the Services.
Changes to these Terms
We may update these Terms as the Services change. We will post the revised Terms here and update the date above. Material changes apply prospectively, and we will provide additional notice when required by law. Your continued use of the Services after revised Terms take effect means you accept them.
